Terms & Conditions

DEFINITIONS

The “Seller” is defined as the legal entity Cutsie Cupcakes Ltd. The “Buyer” means the person (legal or natural) who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer.

 

GENERAL

These Terms & Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other Terms & Conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Cutsie Cupcakes you agree to be legally bound by these Terms & Conditions and accept that these Conditions may be modified or amended and posted on this website from time to time.

 

PAYMENT AND DEPOSIT

With the exception of Wedding Cake purchases, we must receive full payment for the goods that you order before your order can be accepted and booked.

 

For Wedding Cakes we ask for either a 50% deposit or payment in full. Where a Wedding Cake deposit has been paid, the balance is due 28 days before the date the cake is to be collected or delivered.

 

Once payment has been received by us we will confirm that your order has been accepted by sending an email with an attached invoice to you at the email address you provide in your order form/consultation. Our acceptance of your order brings into existence a legally binding contract between us.

 

REFUNDS AND CANCELLATIONS

Deposits made for Wedding Cake purchases are non-refundable and non-transferable under any circumstance due to any loss of business arising from turning away other booking on that order date. If a Wedding Cake purchase was paid in full at the time of booking, only 50% of the full amount will be refundable if at least 28 days’ notice is given for the cancellation. Any Wedding Cake orders with less than 28 days’ notice is not refundable due to any loss of business from turning away other orders.

 

For any other orders, refunds will be given in full if 28 days’ notice from the order date is given. If an order is cancelled with 14 days’ notice from the order date only 50% is refundable. Any orders cancelled with less than 14 days’ notice given is non-refundable due to loss of business.

 

In the very unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible and discuss the matter with you and try to agree a suitable alternative. If you do not wish to accept our suggested alternative, then we will refund the full price to you.

 

PRODUCT INFORMATION

The images on our website & social media are examples of our previous cakes/products. All our products are handmade and can be ordered in different sizes/colours from those shown in the images, your cake may have variations from the image due to the handmade nature of the product.

 

PRICE QUOTATIONS

All price quotations, written or verbal, are valid for 30 days for Wedding Cakes and 14 days for novelty and other baked items from the date of quotation. Any quotes given are non-negotiable.

 

AMENDMENTS

If you have any queries or need to make any changes to an order please contact us immediately. Alterations and amendments must be submitted in writing. We will assess the request for an alteration and endeavour to make alteration where possible dependant on the design and amount of notice given. We will let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 2 weeks before completion may be subject to a surcharge. It is the Buyer’s responsibility to check any quotes and invoices thoroughly before making payment. We reserve the right to change the design at any point if circumstances beyond our control compromise the quality of the finished product. E.g. weather conditions. The Buyer will be notified of any such changes and we will endeavour to keep any changes minimal.

 

DAMAGES

The Seller accepts no liability for cakes that are damaged after they have been delivered to the agreed location. For cakes delivered to venues, the Seller requires a signed delivery note by the person in charge to say that the cake has arrived and that it arrived in perfect condition. Cakes collected from Cutsie Cupcakes Ltd (Cutsie Cupcakes, High Street, Cookham, Berkshire, SL6 9SJ) requires a signed delivery note by the person who is collecting the order to say that the cake is in perfect condition. Damages after this point are not Cutsie Cupcakes Ltd’s responsibility.

 

DELIVERY CHARGES

Delivery charges vary according to the delivery address and cannot be refunded.

 

DELIVERY AND COLLECTION

We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate and a reachable contact number is provided for delivery. Please be precise about where you would like the goods left if you are out when we deliver (for example with a neighbour). We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. We will aim to deliver the goods on the date quoted for delivery but delivery times are not guaranteed. We will always endeavour to deliver within the given time slot. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery time.

 

You will become the owner of the goods you have ordered when they have been delivered or collected. We cannot be held liable for any damages to the cake or products we have delivered once we have delivered or delivered and set up the cake at the venue or delivery location and received a signature for the safe receipt of the goods on our delivery note (we will deliver with a delivery note). If the cake or products are collected from us, we cannot be held liable for any damages to the cake or products once they have left our premises. The collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Buyer. The cake or products can be very fragile so we advise to drive very slowly and carefully and purchase non-slip matting.

 

AFTER DELIVERY

Goods placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damage to Goods. Please note, we do not provide cake tables, tablecloths or cutting knives. It is the responsibility of the Buyer to provide these or check with the venue to ensure these items are provided. A shelf life and Best Before Date will be provided on the Delivery Note. This is advisory only. Please note, once cakes have been cut into the shelf life will be reduced.

 

STORAGE

Cakes should be stored in a cool place and on a flat stable surface. Cakes should not be refrigerated. If stored correctly chocolate or vanilla sponges should last for five days and fruit cakes for three months.

 

ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

Please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options, however, our products are not suitable for those with allergies as our kitchen handles wheat and nuts.

 

NON-EDIBLE INGREDIENTS AND DECORATIONS

Our Goods may contain non-edible ingredients or decorations, such as wooden dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving or eating.

 

CAKE STAND HIRE

We offer cake stand hire. A hire fee plus a security deposit is required in advance. We have a selection of stands and will provide the stand best suited to the cake. It is the Buyer’s responsibility to return the cake stand/s after hire to our Shop address within 7 days. The deposit will not be refunded in the event that the stand/s is/are damaged, or returned after 7 days. We are not liable for any damages that occur to the cake stand before we receive it back. Once the stand is returned within the given timeframe and we are satisfied that it is not damaged we will issue security deposit refund to the Buyer.

 

COMPLAINTS

If you wish to make a complaint to us or let us know any concerns after receiving/collecting the Goods, please do so in writing to: info@cutsiecupcakes.com. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.
